Welcome to Cozy Crime Files! The terms “we”, “us” and “our” refer to Cozy Crime Files. Cozy Crime Files operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Cozy Crime Files is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these “Terms of Service”) describe your rights and responsibilities when you use the Services. Please read these Terms of Service carefully, as they include important information about your legal rights.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. We have made every effort to provide an accurate representation of our products in our online store, including the file format, number of pages and contents of each product. Colors may differ slightly from how they appear on your screen or when printed, due to your device, printer and settings. All descriptions of products are subject to change at any time without notice. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.

2A. Licence for digital products
When you buy a digital product, you receive a personal, non-transferable licence to download, print and use it for your own private, non-commercial use, including playing it with family and friends. You may not resell, share, distribute, upload or publish the files, in whole or in part, or use them for commercial events without our written permission. All intellectual property rights in our products remain with Cozy Crime Files.

3. Orders
When you place an order, you are making an offer to purchase and authorize us and our payment processors to charge your selected payment method for the total amount of your order. Cozy Crime Files reserves the right to accept or decline your order at its discretion, subject to applicable law. Your order is not accepted until Cozy Crime Files confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting. Your rights to cancel a purchase of digital content are described in our Refund Policy. In the event that we do not accept, make a change to, or cancel an order, we will notify you by contacting the email address provided at the time the order was made. Your purchases are subject to our Refund Policy and applicable consumer law. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale.

3A. How to place an order
To place an order, add the product to your cart, agree to receive your digital files immediately where indicated, proceed to checkout, enter your contact and payment details, and confirm your purchase. Before confirming, you can review and correct any errors in your order on the checkout page. The contract is concluded in English. After your purchase, we will send you an order confirmation by email, which you can keep as a record of your order. We also store your order details, which you can request from us at any time.

4. Prices and billing
Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Prices shown to customers in the European Union and the United Kingdom include VAT. Prices in other markets may exclude local taxes, which are added at checkout where applicable. Prices posted in our online store may be different from prices offered in other stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms of Service. If there is a conflict between the terms for a promotion and these Terms of Service, the promotion terms will govern.

You represent and warrant that (1) you are authorized to use the payment method you provide, (2) the information you provide for such payment method is true, correct and complete, (3) charges incurred by you will be honored by the provider of your payment method, and (4) you will pay charges incurred by you at the posted prices, including any applicable taxes.

5. Digital delivery
Our products are digital and are delivered by download, as described in our Digital Delivery Policy. If you have trouble accessing your files, contact support@cozycrimefiles.com and we will help you.

6. Intellectual property
Our Services and products, including but not limited to all trademarks, brands, stories, characters, case files, text, images, graphics, video, and audio, are owned by Cozy Crime Files or its licensors and are protected by applicable trademark, copyright and other intellectual property laws. The purchase of any product does not grant or confer any intellectual property rights in or to the product, other than the personal licence described in section 2A. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, or transmit any of the material on the Services or in our products without our prior written consent. Unauthorized use may violate applicable intellectual property or other laws. All rights not expressly granted herein are reserved by Cozy Crime Files. Shopify’s name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

7. Optional tools
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control over. We provide access to such tools “as is” and “as available” without any endorsement. Any use by you of optional tools offered through the site is at your own discretion, and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). We may also, in the future, offer new features through the Services. Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

9. Relationship with Shopify
Cozy Crime Files is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with Cozy Crime Files. Shopify is not responsible for any aspect of any sales between you and Cozy Crime Files.

10. Privacy policy
Our Privacy Policy explains how we collect, use, and disclose personal information from your use of the Services. Because the Services are hosted by Shopify, Shopify collects, uses, processes, and stores personal information about your access to and use of the Services, including information about your transaction, for purposes including providing, securing, and improving the Services, processing transactions, and helping prevent fraud. You represent and warrant that you own or have all necessary rights to your Feedback, that you have disclosed any compensation or incentives received in connection with it, and that it is truthful and reflects your genuine experience. Please do not post solutions or spoilers to our cases. We may monitor, edit or remove Feedback that we reasonably determine to be unlawful, offensive, defamatory, contains spoilers, or violates any party’s rights or these Terms of Service. If a product is listed at an obviously incorrect price due to an error, we may cancel the order and refund you in full.

We may terminate this agreement or your access to the Services in accordance with applicable law, and you will remain liable for all amounts due up to and including the date of termination. Termination does not affect any orders already placed or any rights you have in relation to them.

Nothing in these Terms excludes or limits mandatory consumer rights, including statutory cancellation rights, the legal guarantee of conformity, remedies for defective or non-conforming digital content, and liability that cannot legally be excluded. The disclaimers and limitations below apply only to the extent permitted by applicable law.

The general information presented on the Services is made available for information purposes. We do not guarantee that your use of the Services will be uninterrupted, timely, secure or error-free. EXCEPT AS EXPRESSLY STATED BY Cozy Crime Files, THE SERVICES ARE PROVIDED ‘AS IS’ AND ‘AS AVAILABLE’. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.

17. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Cozy Crime Files SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICES.
